Implementation of Criminal Sentencing for Perpetrators of Crimes of Minors

Abstract

Prison sentences against children in conflict with the law are still dominant in judicial practice in many developing countries, although legal frameworks have adopted restorative justice. This study aims to analyze the pattern of implementation of criminal penalties against juvenile offenders and identify factors that influence the judge's decision. This study uses a sequential explanatory mixed methods design. The primary data source was obtained from in-depth interviews with 24 informants consisting of six juvenile judges, four public prosecutors, four legal advisors, four Bapas social workers, and six child offenders who have served criminal sentences, as well as observations of ten trials. Secondary data in the form of 150 court decisions for the 2019–2025 period were analyzed statistically descriptive and inferential. The results of the study showed that 62% of the verdicts imposed prison sentences, especially for cases of violence (78%) and theft with aggravation (71%). The three dominant factors that affect judges are the pressure of the victim's family (81%), the limitations of rehabilitation facilities (73%), and the recommendations of community research reports that are often ignored (68%). A significant gap was found between normative commitments to restorative justice and judicial practice, where only 22% of judgments fully reflected these principles. This study concludes that the implementation of juvenile punishment is still retributive and requires binding penal guidelines and strengthening rehabilitation infrastructure
