Implementasi Penjatuhan Pidana Terhadap Pelaku Tindak Pidana Anak Di Bawah Umur

The implementation of criminal sentencing against minors often deviates from the principle of restorative justice mandated by Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, thus causing inconsistencies between judicial norms and practices. This study aims to analyze the implementation pattern of criminal imposition, identify the determinants of implementation deviations, and formulate a responsive juvenile criminal justice policy model. The type of research used is empirical legal research with a mixed-method sequential explanatory approach. The research data source consisted of 100 juvenile court decisions from five provinces for the 2018–2023 period selected by purposive sampling, as well as primary data from in-depth interviews with 18 informants consisting of juvenile judges, prosecutors, advocates, and social workers. The results showed that 68% of the verdicts imposed prison sentences with an average of 1.8 years, and 45.6% of them actually met the criteria for punishment. The three main determinants of implementation deviations were public pressure/media coverage (OR=4.2), lack of adequate litmas reports (OR=3.8), and children's age close to 18 years old (OR=2.5). This study concludes that the implementation of juvenile punishment is still dominated by a retributive approach, so it is recommended that the need for penal guidelines based on risk assessment and quality strengthening is recommended
