Reaktualisasi Maqashid al-Syariah dalam Keluarga Karir: Membangun Keluarga Sakinah di Tengah Dinamika Ekonomi Modern

Abstract

The transformation of the global economic structure has changed the landscape of contemporary Muslim family life, particularly in Indonesia, where women's participation in the labor market has become a structural reality that challenges the Islamic family legal framework that still assumes a relatively fixed gender-based division of roles. This research aims to analyze and formulate a model of reactualization of maqashid al-sharia that is relevant to the reality of career families in the context of contemporary Indonesia. This research is a qualitative research with a normative-empirical approach. Primary data sources include Muslim married couples living a career family life, legal documents such as the Compilation of Islamic Law and religious court rulings, while secondary data sources are obtained from reputable academic literature and classical and contemporary jurisprudence. Data collection was carried out through in-depth interviews, documentation studies, and literature studies, which were analyzed using Miles and Huberman's interactive analysis model and guaranteed validity through the criteria of credibility, transferability, dependability, and confirmability. The results of the study show that Muslim career families have experienced a shift in the pattern of economic relations from a unilateral model to a partnership model, developing adaptive strategies that are in line with the principles of maqashid al-sharia, but still facing a gap between positive legal norms and contemporary career family realities. This study concludes that the reactualization of maqashid al-sharia requires the reconstruction of the concept of livelihood from a unilateral paradigm to a mutual and proportional partnership paradigm, so that the sakinah family can be realized in the midst of modern economic dynamics without losing its Islamic identity.
