Hukum dan Budaya: Menganalisis Persimpangan antara Sistem Hukum dan Praktik Budaya dalam Masyarakat Islam

Abstract

This study aims to analyze the intersection between the Islamic legal system and cultural practices in Islamic society, with a focus on how the two influence each other in the application of law at the local level. This study uses a qualitative approach with the data triangulation method, which involves in -depth interviews, field observations, and document studies. Sources of research data were obtained from 30 informants consisting of religious leaders, judges, legal practitioners, and local communities in Aceh, Indonesia, who had knowledge of the interaction between Islamic law and local culture. The purpose of the study is to explore how local culture influences the application of Islamic law in the settlement of social, family and inheritance disputes. The results showed that customary culture had a significant influence on the practice of Islamic law, with people preferred customary approaches that were more flexible and relevant to their social conditions, especially in cases involving heritage and marriage. The interpretation of Islamic law in Aceh also tends to be adapted to local cultural norms, allowing convergence between the two. This finding illustrates the importance of integration between religious law and local culture in creating an adaptive legal system and accepted by the community.
